Optimum Communications’ co-op antitrust litigation has an expected timeline

In a joint letter submitted by the named defendants which includes Apollo, Ares, BlackRock, GoldenTree, JP Morgan Investment Management, Loomis Sayles, Oaktree and PGIM, as well as the plaintiffs Optimum Communications fka Altice USA and CSC Holdings, the parties have collectively requested the following extended timeline:

  • 6 February, 2026 — named defendants’ deadline to file a motion to dismiss the Complaint;
  • 27 March 2026 — plaintiffs’ deadline to file an opposition to the motion to dismiss;
  • 17 April, 2026 — named defendants’ deadline to file a reply.

These dates reflect an extension under the rules of federal procedure and were requested in light of the holidays and complex nature of the issues presented in the complaint.

Notably, this timeline specifies that it is limited to the “named defendants” as more defendants are expected to be identified and included in the case. The currently named defendants are represented by Sullivan & Cromwell, as previously reported. The plaintiffs are represented by Kellogg Hansen as previously reported.

Additionally the court has set 19 February 2026 for a pretrial conference. The conference will be held in Courtroom 14C of the Daniel Patrick Moynihan United States Courthouse at 500 Pearl Street in Manhattan at 12:30pm before Judge Jeannette Vargas. Prior to the conference the parties are to submit by 12 February 2026 an additional joint letter that sets out, among other things, a brief overview the nature of the action and principal defenses, basis for jurisdiction and venue, any discovery and attempts to settle or mediate to date.
